Terms and Conditions

  1. In these Terms and Conditions, the following expressions shall have the meanings given to them as follows:-

    “VICT” means Paul Warner, trading as VICT Consultancy;

    “the Client” means the person or persons or their principals from whom payment for the Service is to be received;

    “Corporate Entity” means a United Kingdom government department, local authority, public sector body, registered charity or business operating or carrying on business within the United Kingdom;

    “the Service” means the provision of any service by VICT as agreed in writing between VICT and the Client.

  2. VICT will provide the Service to the Client on the conditions set out in these Terms and Conditions as supplemented or varied by agreement in writing.
  3. The Service shall be provided at the then applicable rates specified in our Charges page
  4. All outlays incurred by VICT on the Client’s behalf for the purposes of the Service shall be reimbursed by the Client on demand.
  5. Except as provided for in Clause 6, it is an essential condition of these Terms and Conditions that the Client shall pay to VICT, either in cash or by such online method as shall be provided from time to time by VICT, the total cost of the Service prior to the commencement of the Service. VICT reserves the right to postpone or cancel the Service either in whole or in part until full payment of the total cost of the Service is received.
  6. Where the client is a Corporate Entity, the Client shall pay to VICT by electronic bank transfer all sums due under the invoice issued by VICT in respect of the Service. It is an essential condition that the Client shall pay all such sums due within 30 days of the date of issue of the invoice.
  7. Should VICT be unable to provide the Service or any part thereof at the time and for the duration as agreed with the Client for any reason solely within the control of VICT, the Client shall be entitled to a refund of any sums already paid in respect of the Service, partial refunds being calculated with regard to the proportion of time during which the Service shall not have been provided due to such reason.
  8. Should VICT be unable to provide the Service for a reason outwith the control of both VICT and the Client, VICT and the Client shall act reasonably in making alternative arrangements to enable the Service to be provided.
  9. By making a request for the Service, the Client shall be deemed to have accepted these Terms and Conditions in respect thereof.
  10. The law of Scotland shall apply to any and all agreements made between the Client and VICT on the basis of these Terms and Conditions.
